By Checking the BOX on the RESERVATION REQUEST I acknowledge that I have read and agree to abide by the reservation terms as listed on the Agreement below.
DAMAGE DEPOSIT
A Fully refundable Deposit of $500.00 will be charged at time of booking.
This deposit is full refundable provided the unit is left in a clean and satisfactory condition. Any extra cleaning required that is not covered by the cleaning fee will be deducted from the deposit and included on your final bill.
ALL UNITS ARE NON-SMOKING
Any sign or smell of cigarette smoke will require extensive cleaning and will for fit your entire deposit.
CLEANING FEE
A non refundable cleaning fee will be charged at time of booking, the fee varies from $100.00 to $200.00 Depending on the property.
This cleaning fee only covers 2 hours of cleaning for a Studio, 3 hours for 1 bedrooms and suites, and 4 hours for our multiple bedroom units. Any extra cleaning required that is not covered by the cleaning fee will be deducted from the deposit and included on your final bill.
Other Deductions from the damage deposit may include, but are not limited to: No show fees, damage to the property and/or inventory, excess departure cleaning or laundry and any other fees and charges incurred buy the guest during their stay.
Complaints or Violations of any of the following items or policies will result in forfeiture of your deposit.
Payment and Cancellation Policy
A deposit equal to 50% of services reserved is due at the time of booking, with the balance due 30 days prior to your first day of travel. The following change and cancellation fees apply. Between 45 to 31 days prior to your first day of travel a 10% cancel/change fee will apply. Between 30 to 15 days prior to your first day of travel a 50% cancel/change fee will apply. Within 14 days of travel, your package is non-refundable and non-changeable.
NSF CHECKS. Dishonored checks will be subject to a $30.00 service charge. Replacement checks not including the $30.00 service charge will not be accepted.
USE OF PROPERTY: Alaska Fly-in Rentals and/or the property owner have the right to enter rental property to make repairs and to Examine and protect property during an emergency. It is agreed that an owner’s agent has the right to show the property to prospective customers upon twelve to twenty-four (12-24) hours notice. Guest agrees to abide by and to have Guest invitees abide by the Rules and Regulations by the neighborhood deed restrictions, whichever is applicable. Management also reserves the right to move a guest to another unit of equal value, with a minimum of 5 days notice.
STATEMENT TO TENANTS: Within fourteen (14 ) days after termination of the residency (or thirty days, if Tenant has not given legal notice) and vacation of the premises, the Landlord shall re credit the credit card on file for a full and specific security deposit offset statement, together with payment of any refund to the resident. (N.B. - Normal wear & tear is defined as ... "deterioration that is the result of Tenant's use of the premises by normal non-abusive living.." AS 34.03.070 (b) )
OCCUPANCY: The apartment is rented based on double occupancy and resident further agrees not to sublet any portion of the apartment. and not to keep any roomers or boarders, or in any other way increase the occupancy of the apartment beyond that specified herein.
Permission in writing must be obtained for guests staying longer than 3 days. In the event of any change in occupancy, the following is required :
(1) Approval from Management;
(2) New, or amended Rental Agreement to be signed by the parties. In the event the above procedure is not followed, a fee of $20.00 per day per visitor will be charged, and the resident(s) can be held liable by management for any action by said occupant(s) or guests terminating in a judgment and / or eviction.
WRITTEN NOTICE OF TERMINATION' OF RESIDENCY REQUIRED:
Month to month tenancy: To legally terminate residency, written notice must be given from the resident to the Manager at least thirty (30) days prior to the first day of the calendar month. Legal termination of residency may not occur on any day other than the first day of any calendar month.
Week to week tenancy: Written notice must be given from the resident to the Manager at least seven (7) days prior to the termination date. Failure to provide legal notice to the Manager will result in Resident owing the entire following period's rent. A Resident may not hold-over past the termination date unless the entire following periods rent is paid in advance, or other arrangements have been established in writing with Landlord. Tenant must vacate apartment and return all keys to this office no later than 2:00 pm on the last day of the period.
Management may also terminate the residency, by likewise delivering to the resident a written notice or email at least thirty (30) days prior to the first day of the calendar month for month to month tenancy, or least seven (7) days prior to the first day of the week for week to week tenancy. If proper notice is not given, security deposit may be forfeited. If resident has paid full rent, and moves out early, after giving proper notice, and management re-rents apartment before the end of the period, any rent so collected will be refunded to the resident
HOLDOVER PROVISION: Rent shall be increased to one and one half times the usual rent at the end of the lease term if the tenant does not vacate at the end of the lease term, or notify and receive the approval of the landlord of a desire to remain in residence beyond the term of the contract period. This holdover extension must be approved by the Landlord.
PICTURE HANGING AND ALTERATIONS: The Resident accepts the premises in its present condition and agrees to surrender the premises at the termination of the agreement in the same condition as the present state, normal wear and tear excepted. The resident shall not paint or make any alteration to the premises without written consent of the Manager. Use of any adhesive on walls doors, or cabinets is strictly prohibited.
KEYS AND LOCKS: Resident is not permitted to change locks without the prior written consent of the Landlord. A fee of $10.00 will be charged for each key lost by a Tenant.
MANAGERS DUTIES DO NOT INCLUDE UNLOCKING DOORS for tenant.
PETS AND ANIMALS: (A) Resident(s) shall not keep, or permit a dog, cat, or any other animal or pet, to be kept in or about the apartment, or; (B) Pets may be allowed upon prior approval of the Landlord. Once approval is granted, Resident must pay a one time $200.00 fee for each pet.
NOTE : Any Resident found to harbor a pet for any length of time as described under (A) above without following the steps outlined in (B) above will be charged a penalty of $50.00 per pet per day, or part thereof.
INSPECTION: Residents shall allow Landlord or his agents, access at all reasonable times to said apartment for the purpose of inspection, or to show said apartment to prospective or actual purchaser, mortgagor, resident workmen, or contractors or to any other person having a legitimate interest therein, or to make necessary repairs or improvements. Landlord shall, wherever practicable, give the resident 24 hours prior notice of his intention to enter the apartment. Resident agrees that in case of emergency or abandonment or to post notices, the Landlord or his agents may enter the apartment without consent of the Resident.
NOTE: Request by Resident for Landlord to perform maintenance, will be deemed to include approval for Landlord or his agents to enter the said apartment to perform requested maintenance work without the need for further request for 24 hour notice of entry.
LIABILITY: Resident agrees that personal property in the Apartment shall be at the risk of the Resident. Resident further agrees not to hold the Landlord liable in any matter for / or on account of any loss or damage sustained by the action of any third party, fire, water, theft or the loss of any articles from any cause, from said premises or any other part of said building(s). Neither shall the Landlord be liable for any injury to the Resident, his family, guests, employees, or any person entering the apartment, building or property of which the Apartment is a part. This clause is not meant as an exculpation of limitation of any liability of the Landlord of any liability arising under law, but is written to explain the Residents responsibilities and liabilities. The Landlord strongly recommends that the resident obtain insurance, to cover the Resident's personal belongings to protect the resident against personal injury liability, and to cover any other liabilities or losses the Resident may incur.
ABANDONMENT: It is hereby agreed that if Tenant is absent for more than seven (7) straight days, and has not notified Manager, and the Manager is unable to contact Tenant, then the apartment will be assumed to be abandoned. All of the Tenant's possessions will be stored at Tenant cost, and Apartment will be re-rented in accordance with AS 34.03.260.
ACCORD & SATISFACTION: No payment by the Resident, or receipt by the Landlord of a lesser amount than the monthly rent therein stipulated, shall be deemed to be other than on account of the earliest stipulated rent, nor shall any endorsement or statement on any check or any letter accompanying any check or any payment as rent be deemed an accord and satisfaction, and Landlord may accept such check or payment without prejudice to Landlord's right to recover the balance of such rent or pursue any other remedy in this Agreement provided.
AMOUNTS DUE: Amounts due under this contract shall bear interest at the higher rate of 10.5% or the rate defined in Alaska Statute 45.45.010(b). Amounts due shall bear interest from the date on the security deposit transmittal. Post judgment interest shall be the higher of the contract rate or the judgment rate.
RE-RENTING: Resident agrees that Owner or Agent shall have the right to show apartment to prospective residents at reasonable times for a period of twenty (20) days prior to the expiration of residency, and after notice to vacate has been given by or to Resident.
PARKING & MOTOR VEHICLE REPAIR: There will be no business conducted regarding engine or equipment (car, truck, boat, motorcycle, etc.) repairs on the premises. Any vehicle or equipment not in continuous use, usable or drivable, or without current registration, will be considered junk, and will be removed at the owner's expense. Parking spaces are for Tenant motor vehicles only, not for storage of other objects. Management will have towed any vehicle improperly parked and Resident will pay all towing charges. NOTE: The use of hose for the washing of vehicles on the premises, is expressly prohibited.
FROZEN OR CLOGGED PIPES: Tenant agrees to keep plumbing and pipes from freezing and clogging, and in the event they become frozen or clogged, to notify the Landlord IMMEDIATELY. Tenant shall be responsible for unclogging any lines which affect Tenant's own residence, at Tenant's own expense, if such lines were plugged or frozen due to negligence on the pan of the Tenant (e.g. leaving window open in cold weather). The application of chemical drain cleaners must be approved by the Landlord prior to use.
GARBAGE: All garbage must be enclosed or wrapped in paper or plastic bags before disposal. Garbage cans or dumpsters are provided for your convenience. Do not leave trash or garbage on patios, balconies, outside front or rear doors. Any garbage not properly disposed of will attract a $25.00 fee, per garbage bag. Please place trash in dumpster in the alley.
NOISE: Tenant is not to use any musical instrument, radio, stereo, or TV loud enough to disturb any other tenant. There will be no exception this rule. It is an offence under Alaska State Law to create a disturbance, noise, etc., after 10:00 pm.
HALLWAYS & COMMON AREAS: Hallways, Common Area's and laundries must not be littered by tenants, and must not be used to store ANY items, including but not limited bicycles, toys, tires etc. Yard furniture is provided at the the property owners discretion. Management will dispose of any items found in laundries, hallways, as well as those left lying around the grounds. Parents must ensure that children's toys are brought inside and stored in their apartment or storage area each evening.
MAINTENANCE: All requests for maintenance MUST be in writing via email and addressed to the Manager. Requests must state Residents name, apartment number, and a description of the requested service, and a suggested time for service. For emergency services call 907-230-1149. It is agreed that an owner’s representative has the right enter the property for inspection or repair of maintenance issues with twelve to twenty-four (12-24) hours notice.
Both Landlord and Resident must comply with the written notice requirement of the Uniform Residential Landlord and Tenant Act when giving any notice if required repairs or other grievances.
LAUNDRY, Wi-Fi, STORAGE, DVD, CABLE TV & HEAD-BOLT HEATERS: Management reserves the right to refuse the use of laundry and storage rooms, Wi-Fi, head bolt heaters, dvd players, cable TV or other gratuitous facilities to anyone. Such facilities as may be provided are gratuitous, and Management assumes no responsibility for loss of use or damage to items therein.
SMOKE ALARMS OR FIRE ALARM SYSTEMS: Safety systems are not to be disconnected or altered in any way. They are provided for Residents safety and protection. It is Tenant's responsibility to replace batteries as needed in smoke alarms.
ILLEGAL ACTIVITY: Any Tenant who uses or allows their apartment to be used for any illegal activity, such as prostitution, drugs, gambling etc., will be served with a Notice to vacate their apartment in accordance with Alaska State Law.
The undersigned has read the entire contents of this Agreement, and any attachments hereto, understands his/her rights and obligations as outlined herein, finds them reasonable and agrees by his/her signature herein that he/she will in all ways abide by them. All provisions of the Uniform Residential Landlord and Tenant Act are incorporated in this lease by reference.
Resident hereby acknowledges receipt of a copy of this agreement, and the attachments hereto, if any.
